Tarrant County Jurors Scolded for Refusing to Convict

A visiting judge criticized a Tarrant County jury for refusing to convict a young DWI suspect. Judge Jerry Ray thought it was an open-and-shut case, but the jury thought otherwise. The jurors were accused of performing jury nullification, where jurors find in favor a defendant they believe to be factually guilty, but it’s more likely the prosecutor’s evidence didn’t stand scrutiny. Breathalyzer machines are based on the flawed premise that everyone has the same ratio of alcohol in their breath as they do in their blood, and most machines exhaust the evidence once it’s tested.
